SECTION 1: DEFINITIONS
In these Terms of Service, the terms “Mountain Movers”, “we”, “us” and “our” refer to Mountain Movers as the brand and manufacturer. “Customer”, “you” and “your” refer to any person or entity that accesses the Website or expresses interest in or purchases Products from us. “Products” refers to all racks, accessories, hardware and related items that we manufacture or sell. “Website” refers to the Mountain Movers online platform and all associated digital services.
SECTION 2: ACCEPTANCE OF TERMS
By accessing the Website or using the show interest process to request purchase information from Mountain Movers, you agree to be bound by these Terms. If you do not agree, you must stop using the Website and our services immediately.
We may modify these Terms at any time by updating this page. Continued use of the Website or continued communication with us after changes are posted constitutes acceptance of the updated Terms.
SECTION 3: GLOBAL USE AND AVAILABILITY
Mountain Movers communicates and ships worldwide. Product availability, shipping times, legal requirements and customs rules vary by country and region. You are solely responsible for compliance with your local laws, vehicle regulations, customs rules and import limits. We are not responsible for products delayed, restricted, held or rejected by customs or other authorities.
SECTION 4: PRODUCT INFORMATION
We make reasonable efforts to ensure product descriptions are accurate. However, colors and finishes may vary due to screen or material differences, dimensions may change slightly due to production improvements, and renders or photographs may differ from the final physical product.
We reserve the right to modify specifications, improve designs or discontinue products at any time, provided this does not conflict with mandatory consumer protection laws.
SECTION 5: PRICING, CURRENCY AND PAYMENT
Prices are typically displayed in euro or another supported currency. Final charges may vary due to exchange rates, bank fees or payment provider charges. Unless explicitly stated otherwise, you are responsible for all applicable taxes, value added tax, import duties, customs fees and brokerage charges.
Our Website does not use a shopping cart. Instead, customers express interest using a show interest button and receive payment instructions by email. Only payment methods communicated through official Mountain Movers channels are accepted. We reserve the right to refuse or cancel any transaction that appears incorrect, incomplete, fraudulent or inconsistent with these Terms.
SECTION 6: ORDERS, SHOW INTEREST AND CONTRACT FORMATION
The checkout process on the Mountain Movers Website functions solely as a show interest mechanism and does not constitute an order, purchase, or legally binding agreement. Submitting information through checkout is only an expression of interest and does not guarantee product availability, pricing, or delivery.
A legally binding contract between you and Mountain Movers is formed only when we confirm product availability, you transfer the full payment using the official payment details provided directly by Mountain Movers, and we confirm receipt and acceptance of that payment in writing.
You are solely responsible for ensuring that payments are sent to the correct official bank account or payment details communicated through Mountain Movers’ verified channels. Mountain Movers is not responsible for losses, delays, or damages resulting from payments sent to incorrect, unofficial, or fraudulent accounts not issued by us.
Many Products are made to order. Once production has begun, orders cannot be cancelled except where mandatory consumer protection laws apply.
SECTION 7: LEAD TIMES AND PRODUCTION DISCLAIMER
Any lead times communicated on the Website or by email are estimates only and do not constitute guaranteed delivery dates. Lead times may change due to supplier delays, logistics issues, customs processing or other events beyond our reasonable control.
Delays do not automatically entitle the customer to cancellation or compensation, except where required by applicable law.
SECTION 8: SHIPPING AND DELIVERY
Shipping times vary depending on destination, carrier and customs procedures. Delivery dates are estimates unless explicitly stated otherwise in writing.
Risk of loss or damage generally transfers to the customer once the Product is handed to the shipping carrier, unless mandatory law provides otherwise. Additional fees may apply if a shipment is returned due to an incorrect address, refusal, or failure to pay customs charges.
SECTION 9: RETURNS AND CANCELLATIONS
Unused and unmounted Products that are not custom or made to order may be eligible for return within fourteen days of delivery, subject to applicable consumer law. Products must be returned in new condition, free from installation marks and in original packaging.
Custom or made-to-order Products cannot be returned once production has begun, unless defective or otherwise required by law. Return shipping costs are the responsibility of the customer unless the Product is defective or we have made an error.
SECTION 10: PRODUCT USE, LOAD RATINGS AND SAFETY
Mountain Movers Products are designed primarily for off-road, overlanding and general cargo use. Published load ratings apply only to the rack system itself when installed correctly and do not represent the load rating of the vehicle roof, rails or body. You must consult your vehicle manufacturer and comply with all vehicle load limits.
By installing and using our Products, you assume full responsibility for correct installation, safe load securing, vehicle operation and compliance with local road and safety laws. Mountain Movers is not liable for damage, loss or injury resulting from installation or use, except where such liability cannot be excluded by law.
SECTION 11: CUSTOMER OBLIGATIONS
You agree to provide accurate contact, vehicle and measurement information, to follow installation instructions, to inspect and maintain mounting hardware, to respect load ratings and to use Products responsibly and lawfully.
SECTION 12: PROHIBITED USE
You may not use the Website or Products for unlawful purposes, submit false or misleading information, attempt to reverse engineer or copy designs, upload malicious code or interfere with Website functionality. Violations may result in immediate termination of access.
SECTION 13: USER CONTENT, REVIEWS AND SUBMISSIONS
By submitting reviews, photos or other content, you grant Mountain Movers a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, publish and display that content for marketing or operational purposes. You confirm that you own the rights to the content and that it does not infringe third-party rights or contain unlawful material.
SECTION 14: ERRORS, INACCURACIES AND CHANGES
Website content may occasionally contain errors or omissions related to pricing, descriptions or availability. We reserve the right to correct such errors and cancel affected transactions where permitted by law.
SECTION 15: DISCLAIMER OF WARRANTIES
Except where required by law, the Website and Services are provided as available and without guarantees of uninterrupted or error-free operation. Warranty coverage for Products is governed exclusively by the Mountain Movers Warranty Policy.
SECTION 16: LIMITATION OF LIABILITY
To the maximum extent permitted by law, Mountain Movers is not liable for indirect or consequential loss, including vehicle damage, cargo loss, personal injury, property damage or financial loss arising from misuse, incorrect installation or use of third-party accessories. Where liability cannot be excluded, it is limited to the amount paid for the affected Product.
SECTION 17: INDEMNIFICATION
You agree to indemnify and hold Mountain Movers harmless from claims or expenses arising from your breach of these Terms, violation of law, or misuse of Products, including incorrect installation or unsafe load handling.
SECTION 18: THIRD PARTY PRODUCTS AND LINKS
Mountain Movers is not responsible for third-party accessories, aftermarket mounts or external websites. Any interaction with third-party products or services is at your own risk.
SECTION 19: PRIVACY AND DATA USE
Personal data is processed according to our Privacy Policy, which explains data collection, use and your rights under applicable law.
SECTION 20: GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Greece. Mandatory consumer protection laws of your country of residence remain applicable. Disputes must first be addressed with Mountain Movers and, if unresolved, handled by the competent courts of Greece unless mandatory law allows local jurisdiction.
SECTION 21: TERMINATION
We may suspend or terminate access for fraud, abuse or serious violation of these Terms. You may stop using the Website at any time.
SECTION 22: SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
SECTION 23: ENTIRE AGREEMENT
These Terms, together with the Warranty Policy and Privacy Policy, constitute the entire agreement between you and Mountain Movers.
